1. Who We Are
WhatToBuy (“we,” “us,” or “our”) operates WhatToBuy.app, an AI-powered shopping assistant that generates contextual product recommendations based on your described scenario. We aggregate publicly available product data from third-party retailers and use large language models to help you find the right products for your situation. We do not sell products directly.
2. Acceptance of Terms
By accessing or using WhatToBuy.app (the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service. These Terms apply to all users, including guests and registered account holders.
3. Account Creation and Access
You may use the Service as a guest or by creating an account. You must be at least 18 years old (or the minimum age of digital consent in your jurisdiction) to create an account. By creating an account, you represent that you meet this requirement.
If you create an account, you are responsible for:
- Maintaining the confidentiality of your login credentials and not sharing them with others.
- All activity that occurs under your account, whether or not authorized by you.
- Providing accurate, current, and complete information in your profile.
- Notifying us immediately at support@whattobuy.app if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to reverse engineer, decompile, disassemble, scrape, or extract data from the Service at scale without our express written permission.
- Use automated tools, bots, or scripts to access or interact with the Service in ways not expressly permitted.
- Interfere with or disrupt the Service, its servers, or infrastructure, or attempt to gain unauthorized access to any part of the Service.
- Submit prompts designed to manipulate, jailbreak, or abuse the AI systems underlying the Service.
- Use the Service to develop a competing product or service, or to benchmark it for such purposes without our consent.
- Infringe the intellectual property rights of WhatToBuy or any third party.
- Transmit any content that is harmful, offensive, defamatory, or otherwise objectionable.
5. AI-Generated Recommendations
The product recommendations generated by the Service are produced by AI and sourced from third-party shopping data. You acknowledge and agree that:
- Recommendations may not always be accurate and may contain errors, omissions, or outdated information.
- Prices, availability, ratings, and product specifications are sourced from third parties and may differ from what is shown on the retailer’s website at the time of purchase.
- The Service does not constitute professional advice (financial, medical, legal, or otherwise). Always use your own judgment before making purchasing decisions.
- You should verify product details directly on the retailer’s website before completing any purchase.
We participate in the Amazon Associates Program, the eBay Partner Network, and other affiliate programs, and earn from qualifying purchases made through links in the Service, at no additional cost to you. Recommendations consider factors such as affiliate relationships, price, ratings, review data, and your stated preferences where available.
6. Your Inputs and Our Outputs
You retain ownership of the prompts and information you submit to the Service (“Inputs”). The product recommendations and shopping carts we generate in response (“Outputs”) are provided for your personal, non-commercial use.
By submitting Inputs, you grant us a limited license to process them for the purpose of providing the Service and, in anonymized or aggregated form, to improve our AI models and recommendation quality.
We will not use your personal Inputs to train AI models in a way that can be attributed to you individually. For more information on how we handle your data, see our Privacy Policy.
7. Third-Party Services and Links
The Service contains links to third-party retailers and uses third-party services to operate (including Anthropic Claude for AI processing and Serper.dev for product data). We are not responsible for the content, accuracy, privacy practices, or availability of any third-party website or service.
Your use of third-party websites is governed by their own terms and privacy policies. Clicking a product link takes you to a retailer’s site where a separate transaction may occur — WhatToBuy is not a party to that transaction.
8. Intellectual Property
All content, branding, software, and technology on WhatToBuy.app — including the WhatToBuy name, logo, and the algorithms underlying the Service — is the property of WhatToBuy or its licensors and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our express written permission.
9. Feedback
If you submit feedback, suggestions, or ideas about the Service, you grant WhatToBuy a perpetual, irrevocable, worldwide, royalty-free license to use, incorporate, and build upon that feedback without any obligation to you. We are not required to keep feedback confidential or compensate you for it.
10. Disclaimer of Warranties
To the fullest extent permissible under applicable law:
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses. We do not warrant the accuracy, completeness, or timeliness of any product recommendations, prices, or availability information.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WHATTOBUY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
In no event shall our total aggregate liability to you for any claims arising under or related to these Terms exceed the greater of (a) the amounts you paid us in the twelve months prior to the claim, or (b) $100 USD. This limitation applies regardless of the legal theory on which the claim is based.
12. Indemnification
You agree to indemnify, defend, and hold harmless WhatToBuy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service in violation of these Terms; (b) your Inputs or any content you submit; or (c) your violation of any third party’s rights.
13. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. You may stop using the Service at any time and request deletion of your account by contacting us.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including Sections 6, 8, 10, 11, 12, and 15 — will survive.
14. Changes to These Terms
We reserve the right to update these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page. For significant changes, we may also notify registered users by email. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in San Francisco, California, and you consent to personal jurisdiction in those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
